Sometimes the courts are wrong. Dred Scott vs Sandford, Koramatsu vs US, Wickard vs Filburn.

Dred Scott said that slaves can be returned to their "rightful owners". The court admitted that it was politics, they didn't want to "damage the Union".

Koramatsu said that EO 9066 violated his due process rights. The Court said that EO 9066 is sufficient. 100,000 native born Americans were kept in concentration camps because they were "Japanese". Some of their sons served in Europe with the US military but Mom and Dad could stay in the camp.

Wickard vs Filburn said that the Interstate Commerce Clause is so broad that Congress can do whatever it pleases under the restrictions of the Interstate Commerce clause. They turned the entire point of the ICC on its head.

The Court has since said that Civil Forfeiture (one of Biden's dumber ideas) does not violate the 5th amendment.
