This desperate rush to collect $500K by the deadline reminds me of a story.
In my yoot, I lived on a ski resort. Halfway through the season, people start asking around after this french guy named Guy. "Have you seen Guy?" or "If you see Guy, tell him I need to talk to him."
After about two weeks enough people are looking for him that they start to put the pieces together. Apparently, he approached a couple of hundred resort staff with this story: "Eh, I am driving up to Banff dis weeken' to get some pot, eh? You want to go in wit' me? Gimme a hundred bucks, and I will split it wit' you, eh?"
Once Guy had collected from all his "buisness partners" he took the first Greyhound back to Kaybeck City.
Get the money, and get the fuck out of Dodge. It's one of the oldest tricks in the book.

What would be the ramifications of all new CrossFit clients signing non-liability forms such as "I agree that CrossFit is in no way responsible for any injuries or conditions I may incur during or after training... blah blah"? Would it hold up or would the trainers still be on the hook despite the client waiving all legal rights?

I axed my lawyer buddy that exact same question regarding a waiver form for clients I with KBs. He basically told me that waivers are feel good pieces of paper for the trainer, and they don't really mean jack shit in a courtroom.
His reasoning is that the client isn't educated enough in the risks of physical training for the waiver to mean anything. And the fact that they come to you seeking your experitise is proof enough that they're not educated.

- Sign a waiver
- Very little to no time going over new client's history (injuries, medical, ability, training background)
- ~10min. of large group demo/education of the WAD's exercises
- Setting the group loose, noobs included, to do the workout as hard and fast as they can

The waivers had better include any and all wild-eyed statements that Couch has made about Rhabdo, death, etc, including any statements to the effect that "rhabdo is the side effect of our workouts" and similar stupid shit Couch has said. If the system's founder has made hyperbolic statements about teh program, but the waivers try to downplay it, then the victim can't be said to have fully understood the true risks of the program.
Look, these guys can't get insured. That alone is terrific evidence.

Let's say I run an affiliate, Kraj Crossfit of Beverly Hills. Now, I really know my shit and I play it safe with clients. My clients are at no more risk training with me than they are driving to work or jerking off their bosses for raises. I've got myself covered in that sense.
Why would I pay into the RRG? If another affiliate is attacked by a lawsuit, what financial repercussions would that have for me, other than the possible loss of the "CrossFit" name? If CrossFit goes belly up because of some idiotic affiliates, how does that hurt me? I could just change my company to Kraj Elite Fitness and continue running my gym as I always have. The only thing I would lose is the right to use the term "CrossFit".
Am I missing something?

Waivers generally suck because you cannot consent (or waive your right) to negligence. If you're in a grappling tourney, and you break your arm, you can't sue because that shit happens in the course of the sport. But if you break your arm because the ref was drunk and he didn't see you tapping for 15 seconds, that is negligence, and you could sue.
It doesn't reach informed consent; that deals with risks that are inherent in the program, i.e. unavoidable risks. The @F rhabdo cases happen because some fuckbag makes a newbie do too many GHD situps. That takes us back to negligence.

Considering that a large percentage of the affiliates likely couldn't run a successful gym business without the Kool-Aid brainwash customer-referring machine that is @F.com, most of them would probably be wise to support whatever will keep @FHQ running however they can. Some realize this, many likely don't (never say that @F doesn't increase ego across broad domains).

This new insurance company requires start-up capital, which is why Cooch is pressuring affiliates to invest in it. Once the capitalization requirements are met, the insurance company will become active and CrossFit affiliates will pay monthly insurance dues to the new CrossFit insurance company.
