Colorado's marijuana dispensaries opened their doors to recreational users this morning, but their first customer was far from someone just looking to have a good time: Sean Azzariti, a Denver-area veteran of the Iraq war who suffers from post-traumatic stress disorder (PTSD), instead purchased weed to help alleviate symptoms of his illness.

Azzariti's purchase was largely a symbolic one, orchestrated by activists who led the charge to pass Amendment 64 — the initiative that made marijuana legal in Colorado — following a press conference. Azzariti, who bought an eighth of an ounce of Bubba Kush and an edible truffle, earlier this year appeared in a TV campaign ad to tout the benefits of marijuana for PTSD. Despite repeated efforts by advocacy groups, only seven states currently recognize PTSD as a condition that would qualify patients like Azzariti to purchase medical marijuana. Colorado isn't one of them — though advocates say that the state's groundbreaking new laws mean that patients with various conditions won't need to push for medical access.

"Making marijuana legal for adults is not an experiment. Marijuana prohibition is the experiment, and the results have been abysmal," said Mason Tvert, director of communications for the Marijuana Policy Project and co-director of the Amendment 64 campaign, in a statement. "Colorado is going to prove that regulating marijuana works, and it won't be long before more states follow our lead."

According to the Denver Post, some 37 stores are now licensed to sell marijuana based on Colorado's new laws, which permit weed purchases to anyone over the age of 21 for any purpose. And while marijuana sales are still illegal under federal law, Colorado is now the world leader with regards to legalizing and regulating the selling and purchasing of weed. Store owners, the Post notes, had to complete myriad applications and inspections, as well as shell out thousands of dollars in fees, to pass muster as licensed recreational sellers.

Question for Johno: how are they handling the weed legalization for public employees in WA? I'm assuming that cops and firemen can get canned for pissing positive because marijuana is still a schedule 1 drug federally?

I have been told here in GA that the legalities would be that if the city or county decriminalizes it then we would most likely not get popped if it comes up in a random, as long as it falls below some arbitrary level they pick, but that if we are hurt on the job and we piss hot on the mandatory then don't bet on workman's comp to cover you.

Drug tests where you have some prep time are easy. Passing one when the chief just shows up and drags you to the lab or when you are hurt on the job can be a bit trickier. This is one of the reasons I don't bother with it unless I have a decent bit of vacation lined up.

I haven't looked into it, but my best guess is that it will take a lawsuit to settle the question.
In WA state, pot is legal for both medical and recreational purposes. So I'll guess that the first test case will be a fire fighter with a respectable medical need for the drug.

Side note - it blows my mind how many grapplers swear by rolling stoned.

If you own guns or plan on buying guns, I would not volunteer information online or offline that you use Pot. Despite the excellent CO and WA state laws, it is against the law for drug users to own and or buy firearms. You are also bannned from owning ammunition.

True. You can bet your ass that other legal substances (prescription anxiety and pain meds) are already being used this way, recreational pot is just one huge ass read flag on top.

The feds don't think it's legal. One of the questions on the form you fill out to buy a gun is something along the lines of "are you an unlawful user of drugs" - so you're not supposed to purchase guns and if you answer no you're perjuring yourself should it ever become an issue.

Because it is only legal at the state level. It's still a federal crime to be in possession of marijuana. And it's an even bigger charge to have weed and a firearm. If you are ever caught with the trifecta (drugs in a largish quantity, guns, largish sum of cash) you're fucked.

Perjury would be hard to prove due to the fact there is no proof of drug use at the time of filling out the form. However you can still be hit with a charge of unlawful possession of a firearm due to drug use

Would it matter who you were stopped by (i.e. state or local cops vs feds)?
