I work as a headhunter (glorified inside sales position). Geographic clause is 50 miles from my old office. New office is across the street. I only have one local client as most of my business is in Los Angeles, and San Francisco. They are fighting with me to scare away any of my former colleagues from joining me. Two of them will most likely make the move in the new year.
Technically I work under a corp to corp agreement. The new firm is allowing me use of their in-house counsel but both the owner of the company and lawyer are very risk-averse. I believe that my old employer is trying to fuck with me and has no intention of going to litigation.
In regards to other trump cards I have nothing more than concerns that would be highly embarrassing if this were to go public. Fake Navy Seal is also lying about his university education. Again, that is a personal matter and not reflective of corporate. However, my old company is a $160MM recruiting firm that doesn't even vet it's own employees. Under direction of fake navy seal, employees do not live up to the terms of the contracts we have in place with customers.
I have an email out to the CFO of the last company (he was cc'd to the cease and desist) and will mention a couple of my "concerns" to him. We will also send a formal response to their lawyers as late as possible.

What? So you have an office and legal council and you're allowed to just go collect people's heads? Are you part of ISIS or what? Something doesn't make sense here. How are you just allowed to "hunt" heads? Do you collect them? Trade them? What value do these heads have?

They would be crazy not to sue you, just because of the example it would set. If you agreed in writing to not work within X area for Y years, they will go after you, and happily lose money doing it, specifically to make sure anybody else with the same idea doesn't open up shop across the street. Companies will generally not get as sick of spending money on lawyers as a private citizen writing checks out of his personal account.
You're describing something really close to the legal definition of blackmail while also tap dancing near shit that involves lawyers. In regards to remedying the in-valid non-compete agreement, they asked me to sign a new non compete in May which I refused to do. In regards to blackmail, I was referring to information that would naturally come out in litigation or in the courtroom as to why I left the company. I don't consider that to be blackmail.

Shape sums it up nicely. Just report that shit to the people that usually make a big deal of that stuff and step away quietly. Might provide enough of a distraction for them to forget about you altogether. No need to take credit. That's where we get into trouble. But revenge is always a dish best served cold.

Check with an attorney. States vary widely on how much weight they give non-competes. In CA, for instance, not worth the paper they're printed on. CA would stymie entirely it's high tech industry of people couldn't move freely about the cabin. Doesn't keep companies from trying. Other states vary. Nothing wrong with having something to hang over the other guy's head that he'd prefer would not come out in normal proceedings and deposing and it's laughable to think it's extortion to use it.
