The real lulz here is that Couch/HQ's strategy is focused on devaluing the brand so Anthos won't purchase it. His and HQ's public threats to walk out if Anthos acquires ownership is known as "grabbing and leaving*," which is prohibited in the well settled body of agency law. A person going out on his own cannot pursue old customers that he wouldn't have otherwise known but for his association with his former business. In other words, Couch couldn't go after the affiliates he garnered under the @F umbrella.
None of that even matters because Anthos won't bother going after departing affiliates. 20%...hell, 50%...of the affiliates could walk and they'd make that up in 1-2 years. But they won't walk because new gyms need @F on their door to bring people in.
Couch isn't going to do shit on his own, either. His baby has grown up, and the collective contributions of the open source fitness model have largely exceeded anything he may have yet to contribute.
Couch--if he leaves (I don't believe he will)--will get out of this deal with a few million, which he will burn through like Mike Tyson. Almost all of the affiliates will stay and will do as well or as poorly as they did before. Many will decide to sell apparel because it will help them make them more money. The good affiliates (that are @F in name only) will do almost as well as they did before. The run-of-the-mill affiliates who leave will flounder without the @F name.
The big losers here will be those who have bitten the hand that would have fed them, the Lynnes and Dos Russells of the world. Their best bet is to hire on as a surreptitious blogger on a congressional staff or PAC.
*Ironic, since his grabbing and leaving provoked the divorce in the first place.

Update on court case from Tweedledee (aka Berger):
Yesterday the divorce court in Yavapai County heard Lauren's interlocutory motion to split the single stock certificate, jointly held by Greg and Lauren, into two separate sets of shares, prior to the final adjudication of the divorce. Also pending before the judge was a motion by CrossFit, Inc., to be joined to the divorce action so that it could be heard as a party in interest, given the ramifications of a sale to Anthos on CrossFit's employees, licensees (the Affiliates), business partners (from the SMEs on out to Reebok), as well as CrossFit's corporate structure and tax liabilities.
The judge heard oral argument on Lauren's motion and then agreed to at least allow the motion to intervene by CrossFit to be submitted and heard by the Court on an accelerated briefing and reply schedule. Oral argument has not yet been scheduled.

The motion by CrossFit to intervene in the ongoing Arizona divorce proceedings between the Company's only two stockholders and directors underscores the impossible conflict under which counsel for the Defendants is operating. Despite repeated requests from Ms. Glassman, the Defendants have refused to retain separate counsel for the Company, with the result being that CrossFit's counsel takes instruction from one fifty-percent equity owner and director in opposition to the other. Counsel for CrossFit has defended this tenuous position by stating that the interests of the Company and Mr. Glassman are perfectly aligned.

So I first thought this video was just Reebok hiring a bunch of washed up gymnasts and Parkourites to give people a false impression of what @F can do for somebody...then I got to the end logo...

Funny thing is, Reebok is probably better off (or at least not much worse off) in a generic "crossfit" world. They have done a good job branding the red delta and the "Sport of Fitness" and they will still presumably own sponsorship rights to the Gaymes.
HQ, on the other hand, is totally fucked. They bring in somewhere around $40 million in revenue a year, but almost $35 miilion of that is people paying for the right to use the mark through cert. and affiliation fees.
