Yep, exactly why universities should not be playing cop. There is a legal system and it should be used. Contrary to the earlier post that thought is progressive in universities, it's not, it's just labeled as such. Just because you have different views about things the conventional wisdom doesn't mean it's progressive. For professors' research groups, the model parallels feudalism. Money is at issue but in a way highlighted in this article as well-rob some poor bastard of his rights based only upon an accusation, you deserve to be held accountable. The statements in the article about his being the same entitlement that lead to the rape highlights the thought process-a man has no rights once he's been accused and suddenly she has a right to have him treated as guilty simply by making the accusation. Don't ever forget that the ruling viewpoint of the university is they mean other people, not their enlightened selves, when talking about these issues.

ARTICLE. Bats is exactly right here, the thought process is to resort to the 'paternalism' that woman are to be protected when they're drunk even when they agree to the sex. Anybody wanna take a swing what happens to drunk driving convictions when we decide that what you do when you're drunk doesn't count because, hey, you were drunk. Or maybe that rule just applies to women.
Would absolutely love to have seen what happened if this guy responded to the accusation with a counter accusation, saying he was drunk, she took advantage and he could not go to anybody because he's man and nobody would believe him. Perfect set-up. University scoffs, police scoff, then it's "see what i mean, nobody believes me because I'M A MAN and everybody thinks I WANTED IT." I do know guys who have lost good relationships because of sex with some other woman when they were drunk. None cried foul or rape.
If anecdotal reports count, here are a couple. Good friend had his ex-wife come in from out of town. Couple of days later he finds things missing in the house to include his guns. They were divorced because she had some, er, spending habits that didn't meet his income and she compensated by selling off household items at times. He tells her she has until the end of the day to get the guns back. She goes and files a restraining order. Makes false claims not only of him threatening her with the guns, but that she is a legal resident at his house. Every time he goes to court to fight it, she fails to show at the proceeding, but is up stairs in the court house getting another order. Despite the fact she was not a legal resident in the home, despite the fact she had a prior felony conviction and was not only in the possession of firearms but selling them, nobody in the system, courts or sheriff would do a thing until he hired an attorney at his own expense to get her run off. She occupied the house for 4 months. Did considerable damage. No charge ever filed against her. Would send the wrong message about domestic violence you see.
Roommate in school. Good guy. Had a girlfriend. Turned out she was engaged. Fiance found out. Rape charges come next. She's the perfect victim. Well educated. Well employed. Pillar of the community. She would never lie. Except she did. Guy was about to go down when another roommate presented the audio tape he made. "Fuck me daddy, fuck me harder, yes, daddy please...." Yep, that's a quote. Good for a laugh and got him off the hook. First she claimed he made her say it, which just goes to show what a sick bastard he is. Then it was clear that the tape went on for some time. Until she tried to sue the other roommate for making the tape.
No idea how representative these cases are, nor does anybody else. We all have stories of things we've seen and heard from people we know. There is no doubt women get raped, are passed out and violated (not to be confused with "I was drunk and would have never done that if I were sober, so it's rape"). Violent assaults do happen. Here people have this funny habit of trying to use statistics in individual cases where there are facts and justify it with the "well we all know what THOSE people are like" form of bigotry. As long as the person fits in that category of <<white, black, cop, woman, man, Jew, Christian, Muslim, frat boy, good girl, athlete...>>. If that's how you mentally determine guilt, you are a bigot, regardless of political affiliation.
